Normally, you have three years from the date of your Illinois work injury within which you must file a claim. Every case is different, however, and there are exceptions to working around this time limit. If you wait, you do risk running out of time and losing your rights. As we said above, we are available for free consultations. If we do handle your case, we charge a standard fee of 20% of whatever we recover for you, as set by state law. There is no fee unless we do recover for you.
Benefits to which you may be entitled if you are injured in the course of your employment include: two-thirds of your lost wages based upon your average weekly wage while you are off work due to the disability from your injury; payment of medical treatment for your injury from a physician of your choice; payment of permanent scarring and any loss of function that you suffer; vocational retraining or education; and reimbursement of prescriptions. Also, if the workers' compensation insurance company refuses to pay any benefits, we can file a claim on your behalf at the Illinois Workers' Compensation Commission. Eventually, an arbitrator will rule on your case. The workers' compensation laws and regulations are complex and unique, but we are well versed in representation even in contested situations such as these. It is true that in many cases, insurance companies or administrative agencies will not voluntarily pay you. It will be our job to fight for your recovery.
