How much is my case worth? This is a very difficult question to answer. The inital injuries you received could worsen or your doctor could find problems that you did not know about. In either instance, the value of your case may increase. The important point to remember is that no one can accurately predict the value of your case until we have all of the evidence that affects your case. How soon after an accident should I see a lawyer? As early as possible. In some cases the investigation done by your lawyer immediately after an accident can make the difference in winning or losing your case. Will I be compensated for the pay I lose due to an accident? Yes, this is a part of your damages. To get you this compensation, we need good documentation. Your doctor must indicate that you have missed work or that you cannot work at your job any longer due to your injuries. Your employer must verify how much work you have missed or the effect of your injuries upon your job duties. If you are self-employed, you must be able to document your loss of earnings. What if the other driver has no insurance (ie. automobile accident cases)? In this situation, the other driver is an "uninsured motorist". We will determine if you have this coverage under your insurance policy, and, if you do, will seek compensation from your insurance company. This is why you paid for uninsured motorist coverage. What should I tell my insurance company when I report an accident (ie. automobile accident cases)? You must report your accident to your insurance company. Give them the basic information about your accident required by your policy. If you are not sure how much to tell them, call Parker and Halliday and we will advise you. If I am involved in an accident should I give a recorded statement to the other driver's insurance company? In many cases it is not a good idea to give a recorded statement to the other driver's insurance company. This statement may be used against you at a later date. It is best to consult an attorney before giving such a statement. How soon will my case be settled? In many cases a settlement can be reached fairly quickly after you have completed your medical treatment and you and your doctor are confident that you have recovered from your injuries. Do I have a claim? If you think you have a claim, but aren't sure, you should consult an attorney. We charge no fee for the initial conference so you have nothing to lose. If we do take your case you don't have to pay a fee until and unless we recover money for you. What are your fees to handle my case? There is no fee to discuss your injury case. If we decide to handle your case, we are paid only if we recover money for you. If I get hurt at work what do I have to prove to have a case? You do NOT have to prove that your employer did anything wrong. All you have to show is that you were injured at work while performing your job or that your work over a period of time caused your medical condition. What if my job causes carpal tunnel syndrome, can I still recover from my employer even though there was no actual accident? Yes. You may be able to recover if your condition can be shown to have been caused by your job duties even through there was no specific accident at work. If I'm hurt on the job do I have to treat with the company's doctor? No, under the Worker's Comp Act you have the right to choose your own physician for treatment, though you may be required to evaluated by the company's doctor at some point. |
